Commercial Litigation & Dispute Resolution Lawyer in City of Manila

We pursue and defend commercial cases before the Manila Regional Trial Court and Metropolitan Trial Court and at the Office of the City Prosecutor of Manila — collection, bouncing-check and estafa complaints, attachment, replevin, and ejectment over commercial space.

Recovering money in Manila is usually a sequencing problem rather than a legal one. A criminal complaint for a bouncing check or estafa filed with the City Prosecutor creates pressure that a civil case alone does not, while the civil action secures the judgment and the remedies to execute on it. A writ of preliminary attachment early in the civil case can freeze assets before they move. Which combination to use depends on the debtor's assets and behaviour, and we advise on that before the first demand goes out.

Frequently asked questions

What is the fastest way to collect a debt in Manila?

For smaller amounts, small claims — no lawyers appear and judgment comes quickly. For larger amounts, a demand followed by a criminal complaint where a bounced check or fraud exists, running alongside a civil collection case with attachment where assets are at risk.

What does a bouncing check complaint require?

Proof of issuance, dishonour by the bank, and written notice of dishonour giving the issuer the opportunity to make good within the statutory period. That notice is where most complaints fail.

Can we recover goods delivered but unpaid?

Sometimes, through replevin, where you retained ownership or hold a security interest over the goods. Otherwise the claim is for the price rather than the goods themselves. What the delivery documents say determines which.
