Frequently asked questions
How long does commercial litigation take in the Philippines?
Most commercial cases at the Regional Trial Court level take two to four years. Small claims and summary procedure cases resolve much faster, and arbitration is generally quicker than court litigation. We give clients a timeline estimate at case assessment.
Should I sue or arbitrate a contract dispute?
Arbitrate if your contract has an arbitration clause — it usually binds you. Where you have a choice, arbitration is faster and confidential, while court litigation suits cases needing provisional relief or precedent. We assess which path fits your objective.
What is an intra-corporate dispute?
An intra-corporate dispute is a controversy among stockholders, directors, or officers about the corporation's affairs. Examples include election contests, oppressive acts, and shareholder buy-outs. These are heard by designated Special Commercial Courts, where we regularly appear.
