Our client refuses to pay for delivered services. What are the options?
A demand consistent with the contract, then either a collection case or, where the contract provides, arbitration. Where amounts fall within the threshold, small claims is fast and does not require lawyers to appear.
How much does a collection case cost?
Filing fees scale with the amount claimed, on top of professional fees. For smaller receivables the economics often favour a firm demand and a structured settlement over litigation, and we will say so.
Can we still sue if we signed a contract with a liability cap?
Yes, but the recoverable amount may be limited by the cap. Some caps are unenforceable, particularly against gross negligence or bad faith. The wording decides it.
