Real Estate & Property Lawyer in Davao City

We advise on Davao land and property: title verification, agrarian coverage and beneficiary rights, ancestral domain considerations, plantation leases and leaseback arrangements, commercial and industrial site acquisition, and property disputes.

Davao land diligence has an extra layer. Beyond title and tax records, a parcel may be covered by agrarian reform with beneficiaries holding rights that survive any transfer, or may sit within an ancestral domain where free and prior informed consent from the indigenous community is required before a project proceeds. Neither issue is visible on the face of a title. Both are fatal to a project discovered late, and both are manageable when addressed before the investment is committed.

Frequently asked questions

What is free and prior informed consent and when is it needed?

Where a project affects an ancestral domain, the indigenous community's consent must be obtained through the prescribed process before it proceeds. It is a legal requirement, not a courtesy, and cannot be retrofitted.

Can plantation land under agrarian reform be leased back?

Arrangements with beneficiaries and their cooperatives are possible and common, subject to regulatory approval and to the beneficiaries' statutory rights. Agreements that undercut those rights are vulnerable years later.

How do we verify Davao land before purchase?

Certified true copy of the title from the Registry of Deeds, chain of ownership, agrarian coverage records, ancestral domain status where relevant, tax declaration and clearances, zoning, and actual possession on the ground.
