Frequently asked questions

How long does annulment take in the Philippines?

An annulment or petition for declaration of nullity under Article 36 usually takes one to three years. The court's docket, opposition by the OSG, and the evidence required all affect the timeline. We give each client a realistic estimate at intake.

Is divorce available in the Philippines?

No — absolute divorce is not available between two Filipino spouses. A Filipino married to a foreigner who obtains a valid foreign divorce may petition for judicial recognition of that divorce here, which we handle regularly.

Who gets custody of minor children?

Children below seven are generally awarded to the mother, absent compelling reasons. For older children, courts decide on the best interests of the child. We build the evidence that supports a parent's custody position.
