Labor & Employment Law Lawyer in Pasig City and Ortigas Center
We act for Ortigas and Pasig employers in illegal dismissal and money claims before the National Labor Relations Commission, at Department of Labor and Employment conferences and labor standards inspections, and in designing compliant shift, pay, and separation practices for large workforces.
High-headcount Ortigas employers face the same claims repeatedly, so the exposure is systemic rather than individual: night shift differential and overtime computation, rest-day and holiday premiums, the treatment of unpaid meal breaks, and team leads classified as supervisory to avoid premium pay. A single arbiter's finding on any of these can be replicated across the workforce. We audit the pay practice first, because fixing the formula is far cheaper than defending it a hundred times.

Frequently asked questions
How is night shift differential computed?
It is a premium on hours worked within the statutory night period, computed on top of the basic rate and interacting with overtime and rest-day premiums. Errors compound across a large workforce, which is why the formula deserves an audit.
Can we dismiss for poor performance?
Gross and habitual neglect or inefficiency can be a just cause, but it requires reasonable, communicated standards, documented performance management, and the two-notice process. Performance dismissals fail most often on documentation, not on merit.
What happens at a Single Entry Approach conference?
A DOLE officer convenes the parties to attempt settlement within a short period before the case proceeds to the NLRC. Sending a representative with real settlement authority is what makes it work.
