Labor & Employment Law Lawyer in Mandaluyong City

We advise Mandaluyong retail, food service, and office employers on employment contracts, shift and premium pay compliance, discipline and dismissal procedure, and defence of cases before the National Labor Relations Commission.

Retail and food service workforces generate a distinctive claim pattern: cash shortages charged to staff, service charge distribution, meal-break treatment during long shifts, and dismissals for dishonesty based on a CCTV clip and little else. Loss of trust and confidence is a valid ground, but only for employees genuinely holding positions of trust and only on substantial evidence — a recording without a documented investigation and two written notices rarely survives review.

Frequently asked questions

Can we deduct a cash shortage from an employee's pay?

Deductions from wages are tightly restricted. Charging shortages without the employee's written authorisation and a proper process exposes the employer to illegal deduction claims on top of the original loss.

How must service charges be distributed?

Service charges collected by covered establishments are distributed to employees in the proportion the law requires. Retaining a share that should go to staff creates a money claim that accumulates across the whole workforce.

Is CCTV footage enough to dismiss for theft?

Rarely on its own. You still need a notice to explain, a genuine opportunity to respond, an investigation, and a decision notice — and the footage must actually show what it is claimed to show.
