Labor & Employment Law Lawyer in Laguna

We act for Laguna employers before the NLRC regional arbitration branch covering CALABARZON and at Department of Labor and Employment proceedings — union negotiations and certification elections, retrenchment and redundancy programmes, contracting compliance, and dismissal defence.

Union presence is more common in the Laguna corridor than in most of Metro Manila, which changes how workforce decisions must be made. A collective bargaining agreement can impose consultation, seniority, or benefit obligations beyond the Labor Code, and a restructuring carried out without honouring them becomes an unfair labor practice claim as well as an illegal dismissal case. We check the agreement before the plan is announced, not after.

Frequently asked questions

What is required for a valid retrenchment?

Proof of actual or imminent substantial losses through audited financial statements, written notice to the employees and the Department of Labor and Employment at least a month in advance, separation pay at the statutory rate, and fair, documented selection criteria.

How does a certification election work?

It is the process for determining which union, if any, represents the bargaining unit. Employers have a limited role and interference is itself an unfair labor practice, so the safest posture is strict neutrality with counsel monitoring.

Can we implement changes a collective bargaining agreement does not cover?

Management prerogative remains, but it must be exercised in good faith and consistently with the agreement and established practice. Withdrawing a long-standing benefit can violate the rule against diminution of benefits.
