Labor & Employment Law Lawyer in Cebu City
We advise Cebu employers in outsourcing, manufacturing, hospitality, and tourism on employment contracts, seasonal and project engagement, discipline and dismissal, restructuring, and defence before the NLRC regional arbitration branch covering Central Visayas.
Cebu's tourism and hospitality employers face a seasonality problem the Labor Code does not accommodate easily. Seasonal employees are not casual — those repeatedly engaged for the same seasonal work are treated as regular seasonal employees, entitled to be recalled and not simply replaced. Handling peak staffing through fixed-term or project arrangements that do not fit the facts creates regularisation claims across an entire cohort at once, which is why the engagement model deserves review before the season, not after.

Frequently asked questions
Can we hire seasonal staff for peak periods?
Yes, but employees regularly engaged for the same seasonal work across seasons acquire regular seasonal status and the right to be recalled. The model should be designed with that in mind.
Are fixed-term contracts valid in the Philippines?
They can be, where the term was genuinely and knowingly agreed without the employer exercising dominance to impose it, and the work fits a fixed term. Serial renewals covering ordinary business activity are usually struck down.
How do we handle a dismissal remotely?
The process is the same wherever counsel sits: a notice to explain, a genuine opportunity to respond, and a decision notice. We prepare the notices and guide the hearing; you conduct it on site.
